The publication is dedicated to the resolution of private law cases and explores in depth the principles and methodology on which it is based. The authors follow the process of preparing the decision step by step and provide the specific rules of legal thinking applicable to any exam or practical case in the field of private law. The focus in terms of subject matter is on the general part of civil and contractual law as two of the most voluminous and fundamental disciplines. Along with the general issues of legal logic, the subsumption of facts, the writing of the decision and its verification, attention is paid to some important and underestimated features in the interpretation and application of civil law, and along with this, some suggestions are offered practical and understandable diagrams and tables, which simplify the work with the relevant legal norms.
Finally they are placed five accessible case studies along with their solutions, which can serve both as a conclusion and a starting point in preparing for case studies.
The aim of the book is to contribute to the methodological diversity in Bulgarian legal education, with an emphasis on case-solving as a basis for the development of a lawyer in addition to the prevailing traditional pedagogical methods in law schools. It can be used as a tool primarily by students in their preparation for state exams and any other exams involving a case study. It would also be useful in compiling and reviewing case studies, as it contains an exemplary methodology for scoring and evaluating. The book will also be useful to any reader who is interested in civil law or the principles of legal thinking.
